Selected neologisms and idioms in the legal language of criminal law in the light of the function of criminal policy

Abstract

The article aims to analyze the phenomenon of creating new words and idioms, describing the existing or created institutions related to the rules of criminal liability, the rules of punishment and types of prohibited acts.

The author, using the method of critical literature review and the methods of word-formation analysis, strives to determine the sources of emerging neologisms and idioms describing the existing or created institutions of criminal law. It examines whether there are uniform rules - in line with the rules prevailing in the Polish language - for creating this type of words and expressions.

After the introduction, general issues such as the concepts of neologism, phraseology and idiom are explained. Next, the presentation and discussion of neologisms and idioms on the basis of circumstances excluding criminal liability is made. In the further part, expressions concerning the circumstances related to the imposition of a penalty are analyzed in a similar way. In the last part of the article, the above procedures are applied to borrowings as the names of particular types of crimes and behaviors that meet the features of some prohibited acts. In the summary, a proposal for a new term for the circumstance excluding criminal liability is made.

The article is devoted to an issue that has not yet been developed in the Polish science of criminal law. There is a lack of a publication aimed at a thorough examination of the process of formation of neologisms and idioms in the field of criminal law and their characteristics. This text fills that gap. At the same time, its author recommends the use of a term created thanks to the conducted research for a circumstance excluding criminality (the clause "is not subject to punishment") - expenant.
