Pet cemetery in context administrative law

Abstract

Research objective: The aim of this article is a normative analysis of legal institution pet’s cemetery in context of administrative law. The intention of this elaboration is to show the need to create a broader normative regulation and unequivocal separation the pet cemetery against cemeteries as places of religious worship.

The research problem and methods: The basic research problem is to show a misunderstanding of the concept the pet cemetery in terms of a cemetery, the need to fill a legal gap by adding to existing legislation standards in the area of burying the pet, administration procedures and competences of public authorities in this area. This elaboration will use the following research methods: dogmatic, historical-doctrinal, legal-comparative and deductive.

The process of argumentation: This article discusses the genesis of the analyzed legal institution, a comparative approach to a pet cemetery in relation to a cemetery and a historical cemetery in the context of local law, building law and monument protection and pet cemetery in terms of public policy.

Research results: As a result of the analysis, it was proved that the problematic matter about the pet cemetery is regarded as a difficult topic mainly in view of moral dimension. The method of burying the pet must absolutely not be similar to the funeral ceremony of a deceased person. Due to the danger of offending religious feelings and the profanation the Christian’s tradition of the funeral ceremony, administrative law norms should be created in the area of legal standards of burying the pet.

Conclusions, innovations, and recommendations: In the current legal status is a lot of ambiguities in proceeding with a dead the pet. Often there are cases breaking the law in conjunction with improper handling of a deceased the pet. Therefore, there is a need for a scientific discussion.
