Abstrakt

CEL BADAWCZY: Celem pracy jest zbadanie głównych założeń amerykańskiego indywidualistycznego anarchizmu jako krytyki wobec konstytucyjnego państwa demokratycznego.

PROBLEM BADAWCZY I METODY: W artykule analizowane są przesłanki, które spowodowały, że indywidualistyczni anarchiści sformułowali swoją tezę o nadrzędnym charakterze praw jednostki i suwerenności jednostki. W konsekwencji doprowadziło ich to do wniosku, że tak zdefiniowana suwerenność jest nie do pogodzenia z jakąkolwiek formą rządów, w tym z demokracją konstytucyjną.

PROCES ARGUMENTACJI: Po podjęciu wstępnych rozważań, rekonstruując rozwój indywidualistycznej teorii anarchistycznej w artykule przeanalizowano wskazywane przez anarchistów niedoskonałości państwa konstytucyjno-demokratycznego.

WYNIKI BADANIA: Rezultatem badania jest wyjaśnienie indywidualistycznej anarchistycznej krytyki państwa, w tym państwa konstytucyjno-demokratycznego. A także opracowanie, dlaczego klasyczne elementy, takie jak kontrola sądowa, konstytucja, prawna ochrona praw jednostki, nie były postrzegane przez anarchistę indywidualistycznego jako wystarczające do legitymizacji władzy politycznej jako takiej.

WNIOSKI, INNOWACJE I REKOMENDACJE:
Przyjęcie perspektywy anarchistów i wprowadzenie do dyskursu porządku bezpaństwowego jako możliwej alternatywy pozwala wprowadzić więcej krytycznych głosów o pierwotnych brakach w legitymizacji władzy państwowej.
